Click Here - Utah Five Day Notice to a Tenant at Will - Your tenant is probably a "Tenant at Will" if you do not have a lease agreement with teh tenant (either written or oral).  Landlords commonly mistakenly believe their tenants are tenants at will.  Even if a lease agreement does not exist, you must properly provide an eviction notice to begin the eviction process.

Examples of a tenant at will:

  • You have a guest who is not on the lease and refuses to leave.
  • You have a tenant whose lease has already expired.
  • The landlord purchased a home through foreclosure with the prior owner occupying the home.  The foreclosure terminates the prior owner's rights and permissions to occupy the property making the prior prior owner a tenant at will.
